These Terms of Service (the “Terms”) govern your access to and use of Moltly (the “Service”), available at moltly.xyz and any related applications or APIs.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

- Eligibility and Accounts
- You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with a parent or legal guardian’s consent.
- To access certain features, you must create an account using a username and password (email is optional) or by using a supported third‑party sign‑in provider such as Discord, Apple, or Google. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
- The Service
- Moltly is a logbook for tarantula keepers to record molts, feedings, notes, reminders, and related photos.
- “Guest mode” stores your data only in your browser’s local storage and does not sync to our servers. If you clear your browser storage, that guest data will be lost and cannot be recovered by us.
- When signed in, your entries, research notes, reminders, and photo attachments are stored on our servers and associated with your account.
- Your Content
- You retain ownership of the content you submit to the Service (including entries, notes, tags, and attachments).
- You grant us a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, process, and display your content solely as necessary to operate, maintain, and provide the Service and related features (e.g., backups, content delivery, and rendering in the app).
- You represent and warrant that you have all rights necessary to upload and share your content and that your content does not infringe any third‑party rights or violate applicable law.
- Acceptable Use You agree not to:
- Upload unlawful, defamatory, infringing, sexually explicit, or violent content, or content that promotes harm to people or animals.
- Attempt to gain unauthorized access to the Service or other accounts, or circumvent rate limits, security features, or access controls.
- Interfere with or disrupt the Service, including by distributing malware, scraping without permission, or performing denial‑of‑service attacks.
- Third‑Party Services
- The Service offers sign‑in via third‑party providers such as Discord, Apple, and Google. Your use of those providers is governed by their own terms and privacy policies. We are not responsible for third‑party services.
- We may use infrastructure and service providers (e.g., hosting and database providers) to operate the Service.
- Content delivery and security: We use Cloudflare as a reverse proxy, content delivery network (CDN), DNS, and security provider (including DDoS protection and web application firewall). By using the Service, your requests may be routed through Cloudflare, which may temporarily cache content and process technical information such as your IP address, country/region, and request metadata to provide its services. - Privacy
- Our collection and use of personal information is described in our Privacy Policy (PRIVACY.md). By using the Service, you consent to our data practices as described there.
6a. Cookies and Security Technologies
- The Service uses strictly necessary security technologies provided by our infrastructure partners. In particular, Cloudflare may set essential cookies or local storage entries (for example, to distinguish bots from legitimate traffic or to maintain access after a challenge). These are necessary to deliver the Service securely and cannot be turned off.
- Modifications and Availability
- We may add, remove, or change features at any time, and we may suspend or discontinue the Service, in whole or in part, with or without notice.
- We are not liable for any unavailability, delays, or failures caused by maintenance, outages, or events beyond our reasonable control.
- Feedback
- If you submit feedback or suggestions, you grant us a perpetual, worldwide, royalty‑free license to use them without any obligation to you.
- Disclaimers
- THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.
- Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- TO THE EXTENT ANY LIABILITY IS NOT LAWFULLY EXCLUDABLE, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $50 OR (B) THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
- Indemnification
- You agree to defend, indemnify, and hold harmless the Service operator and its affiliates, officers, agents, and employees from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from (a) your use of the Service; (b) your violation of these Terms; or (c) your content.
- Termination
- You may stop using the Service at any time. You can delete your account in the app, which permanently deletes all synced data associated with your account, including: molt/feeding entries, health entries, breeding entries, research stacks and notes, specimen cover images, and all photo attachments you have uploaded.
- We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or to address security or operational risks.
- Changes to These Terms
- We may revise these Terms from time to time. If changes are material, we will provide notice by reasonable means (e.g., updating the “Last updated” date, in‑app notice, or email if appropriate). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

- If you deploy the Moltly software yourself, you are solely responsible for your own terms and privacy practices. These Terms apply to the hosted Service operated by the operator named above.
